AAG Mobile Application End-User License Agreement

Terms of Use

This license governs the legal relationship between the manufacturer of the Application, AAG Mobile Application ("AAG") and/or Switch Solution LLC and/or its designees, including any entity that acquired the rights to use the Application, and the end User (the "User"), in connection with the use of the "Odin Ticketing Service Call" Application (the "App" or "Application"). From the date of installation of the Application the User is subject to the following terms and conditions ("Terms of the License") .If you do not agree to the Terms of Use, you must cease all use of the Application and delete it immediately from your device. AAG and/or Switch Solution LLC may change the Terms of the License at any time without notice, and this change will require the User in all respects from the date of publication.
You may make unlimited App installations on your mobile device, which meets the Application installation requirements. Using the App is as specified in the license, as updated by AAG and/or Switch Solution LLC from time to time. Using the Application, in whole and/or in part, is a private-personal use only. Any action and/or other use, including, among others, commercial use, distribution, copying, modifying, rent, reverse engineer, creating derivatives and translation are strictly prohibited. Information

The use of the information in the Application ("Information") is at your own risk and it does not impose liability on AAG and/or Switch Solution LLC and/or its designees in connection with any injury and/or damage and/or loss of the User and/or property, including injury that caused death. Despite AAG and/or Switch Solution LLC efforts and attempts to provide updated information as possible, and subject to security and/or geographic and/or economic restrictions, the Information is on "as-is" basis of the date of writing, and therefore might be inaccurate or out of date. AAG and/or Switch Solution LLC is not responsible for any direct or indirect damages that may be caused to the User and / or property because of such inaccurate Information. If the Application will contain identifying location of various services such as gas stations, restaurants, cafes, and more, these figures are correct as preparation only. AAG and/or Switch Solution LLC is not responsible for changes and/or accuracy of the information regarding third party services, and they are presented as a service to the User. In any case the responsibility for the quality and/or the service is the services providers’ sole liability.

Content Application

The Application is an App that allows mobile communication channel in number of content areas such as Transportation help Desk, Messages ,Ticket Status, Ticket BI and etc.
According to the decision AAG and/or Switch Solution LLC and / or its designees, it will be allowed to add/download /use of all business processes that appear in this document or any part of the above processes. Please note that all content has varied processes that are implemented based on requirements from the manufacturer.
Since AAG and/or Switch Solution LLC cannot test and verify all the information and/or content received by external factors, then In the event that the App will contain content introduced by the Users and/or any third party, including recommendations, requests, inquiries, description of safety events, information marketing, advertising, operating, etc., it is hereby clarified that in such a case AAG and/or Switch Solution LLC and/or on its designees will not be liable in connection with the use of such information. AAG and/or Switch Solution LLC and/or its designees shall not be liable for any direct, indirect, financial or other damage that may be caused to User runs the Application service due to the use and/or reliance on the information. It is clarified that the content of the Application was made on a subjective discretion, and the recommendations presented in the Application has no binding obligation.

Intellectual Property

All copyrights and intellectual property rights Application and the information in it, contents, if any, source code, design and editing, as well as any updates, amendments and corrections, are the exclusive property of AAG and are protected by copyright and international conventions regarding copyright.

User Declarations

If the User rank and/or review the Application, the User undertakes that the ranking will be done in good faith, based on personal opinion and without influence of extraneous considerations or commercial interests, and that any information published by him will be accurate, reliable and useful.

Privacy Protection

Using the App, you agree that the information provided by you, including, among other things, location of your mobile phone, while using the App will be kept in the database of AAG and/or Switch Solution LLC and will serve AAG and/or Switch Solution LLC to purposes permitted under the Terms of the License and/or by law. AAG and/or Switch Solution LLC will not transfer personal information to third parties and/or identifying information about the User except in the following cases: AAG and/or Switch Solution LLC manages and implements systems and procedures for information security that reduce the risk of unauthorized penetration of its servers. However, for the avoidance of doubt, AAG and/or Switch Solution LLC cannot guarantee that the App is immune to unauthorized access to information stored in it.
Material Marketing / Advertising
Using the App, you consent to receive promotional SMS / mailings / marketing / operational in relevant content.

Liability and Indemnity

AAG and/or Switch Solution LLC and/or its designees, including any entity that acquired the rights to use the Application, is not responsible and cannot not guarantee that unauthorized body will not get access to information which was provided by a User. Each User assumes full responsibility and risk related to the use of the App. AAG and/or Switch Solution LLC and/or its designees, including employees, managers and/or its information providers, are not responsible in any way, expressly or implicitly, to information in the Application and/or information received from third parties, its suitability for the User, reliability and/or accuracy and/or usability and/or use of that information and/or contents of the Application. AAG and/or Switch Solution LLC does not commit itself to the User's availability and/or the functioning of Application and/or access to information in Application at any time, or in the event that using the App cause disruptions or failures in obtaining data from the Application, whether because of AAG and/or Switch Solution LLC or whether because of another factor, including malfunctions and/or disorders on the Internet and transferring wireless data. You may find the information and contents of the Application do not correspond to your needs or that you object to their content or consider them to be aggravating, annoying, improper, illegal or immoral. In this please contact AAG and/or Switch Solution LLC. It is clarified that AAG and/or Switch Solution LLC will take care each case in its sole discretion. AAG and/or Switch Solution LLC encourages the User to treat the Information published in the Application carefully and critically. As to professional information, please notice that this information should be treated cautiously and carefully, and remember that the said information is not a substitute for consultation with the appropriate professionals. AAG and/or Switch Solution LLC is not responsible for the service center of the vehicle manufacturer, importer of the vehicle and/or rental/leasing company and/or service providers and/or Fleet managers in issues of receipt of the information send by the App and replaying to the User. For the avoidance of doubt, AAG is a company that develops and maintains the App as an additional communication channel between customers and vehicle manufacturers, vehicle importers and a group of vehicle rental/leasing and/or service providers and/or Fleet managers and their service center. The User undertakes to indemnify the AAG and/or Switch Solution LLC, employees or anyone on its behalf for any damage and/or loss and/or expense they incur, including attorneys' fees and court costs, due to violation of license terms.

Changes in Application and termination of service

AAG and/or Switch Solution LLC may modify and/or update, add or remove the Application or the Information in it. AAG and/or Switch Solution LLC may remove and/or restrict the use of the App for a limited period of time or permanently in its sole discretion and without notice. AAG and/or Switch Solution LLC may change the Terms of the License at any time without notice, and this change will require the User in all respects from the date of publication.

User Commitment

You undertake and acknowledge: (a) to provide correct, true, complete and accurate information about you as requested in the registration process; (B) update the information provided in the registration process and maintain its accuracy and correctness (c) knowing that you are fully responsible for maintaining the confidentiality of your application password; And (d) promptly notify AAG of any unauthorized use of your password and / or any other breach of confidentiality.

Encryption

Communication between the app and the AAG server is encrypted and secured using state-of-the-art encryption methods and encryption mechanisms that are standards for information encryption issues in the Internet world. The secure connection prevents the information being transmitted from being visible to other Internet users. We use a variety of components including SSL and more. Please note: The app must only be downloaded from the online stores of the mobile device manufacturers, and not from any other source.
